The Uneven Battlefield: A Defense Investigator’s Reality

In criminal cases, the defense doesn’t just start behind—it starts at the bottom of a hill while the state stands at the top with a full tactical advantage. Prosecutors have police, DA investigators, labs, experts, warrants, and the authority that comes with a badge. The defense?
They have a lawyer… and if they’re lucky, an investigator.

Even then, defense teams often operate on limited funding, limited time, and even more limited access. Subpoenas get denied. Discovery gets slow-walked. Evidence arrives in impossible formats at the last possible minute. The state is required to hand things over—but no one said it had to be neat, organized, or even usable.

So defense investigators spend hours decoding proprietary video, troubleshooting corrupted files, and piecing together information without the forensic tools that police labs take for granted. Investigators on the state’s side have badges and access. Defense investigators have curiosity, persistence, and a stubborn commitment to uncovering the truth.

And that commitment is everything.

When I approach witnesses—no matter which side they land on—I’m not there to push an agenda. I’m there to understand. My loyalty is to the facts, full stop. Facts aren’t good or bad; they simply are. But attorneys can only fight fairly if they know all of them.

Before I speak to a witness, I’ve already done my homework: public posts, background details, news coverage. By the time I knock on a door, I usually have a sense of who they are—sometimes even the feeling that if life had played out differently, we’d probably be friends. That’s why it stings a little when someone refuses to talk.

But I’ve learned their refusal isn’t personal. It’s about the “side” I represent. And while witnesses absolutely have the right to stay silent, it’s hard not to wish for a world where people simply share what they know so both sides can seek the truth.

This isn’t that world.

Witnesses are often told they don’t have to talk—because legally, they don’t. And it’s much easier to turn away a private investigator than an armed detective at the door.

Still, I know my place in the system. I know why people hesitate. And yes…
it can be disappointing.

But that’s the job.
And despite the imbalance, despite the challenges, despite the closed doors, we keep showing up—because the defense deserves the truth just as much as the state.

And someone has to go find it.
